NY Law Limiting Pay-Delay Damages Survives Wage Case Challenge

A New York federal judge upheld a state law amendment barring extra damages in wage cases brought by manual labor workers who seek to be paid weekly.

The 2025 amendment to ban liquidated damages was properly enacted as a bill recommended by Gov. Kathy Hochul (D) to the state legislature alongside a budget proposal, Judge Arun Subramanian of the US District Court of the Southern District of New York ruled Wednesday. Subramanian, a Biden appointee, also held that the law doesn’t violate the Due Process Clause of the New York Constitution.
