Penske Truck Leasing Co. failed to completely dismiss an ex-worker’s proposed wage-and-hour class action after a federal court said he adequately plead allegations over reimbursement, wage statements, and his final check.
But Jaime Garcia, who was once a Penske technician, failed to state a period of time that he was either underpaid or denied meal and rest breaks, the US District Court for the Eastern District of California said, dismissing four of his claims against the truck rental company.
Garcia sued Penske earlier this year, alleging that the company violated several provisions of the California Labor Code.
