Puerto Rico Influenza Epidemic Triggers Emergency Sick Leave Law

Puerto Rico Gov. Jenniffer González-Colón (R) declared a state of emergency Jan. 27 in response to an ongoing influenza epidemic, triggering the island’s emergency sick leave law.

The state of emergency was declared in Executive Order 2026-005 (Spanish), which automatically caused a provision of the Puerto Rico Vacation and Sick Leave Act to go into effect. The provision, created through Act 37-2020 during the Covid-19 pandemic, entitles covered employees to up to five additional days of paid sick leave during public health emergencies.
