Tennessee employers with at least 35 employees must use E-Verify for all employees hired on or after Jan. 1, 2023, under a bill (H.B. 1853) Gov. Bill Lee (R) signed that is effective May 9.
Current state law requires employers with at least 50 employees to use E-Verify for all new hires. Tennessee law forbids employers from hiring illegal aliens.
Employers will not violate state law if E-Verify provides false results on an employee’s work authorization status or E-Verify is either suspended or no longer operational, under the bill.
