Texas Supreme Court Lets Stand Ruling Against Austin Sick Leave

June 8, 2020, 7:07 PM UTC

An Austin sick-leave ordinance cannot be enforced after the Texas Supreme Court on June 5 let stand an appeal court decision that the rule violates state minimum-wage law.

The paid sick-leave ordinance, which the Austin City Council passed in February 2018, generally required private employers to allow workers to accrue up to 64 hours of paid sick leave in a year.

An Austin appeals court in November 2018 ruled that the ordinance conflicted with the Texas Minimum Wage Act, which establishes a statewide policy.

The case is City of Austin v. Tex. Ass’n of Bus., Tex., No. 19-0025, petition for review denied 6/5/20
