Texas Justices Skip Case Over Wind Farm’s Property Tax Break

The Texas Supreme Court won’t review whether a neighbor has standing to sue the state comptroller for approving a wind farm’s property tax abatement that topped $10 million.

A state appeals court ruled last year that Suzonne Franks’ alleged injuries—misuse of taxpayer money and diminished property value—aren’t traceable to the Texas Comptroller of Public Accounts. Franks argued in her petition for review that traceability isn’t part of the test for taxpayer standing.
